These Terms of Use govern the relationship between Coinsafe and the individuals and companies that use the coinsafe.com.br website and the Coinsafe trading platform. By creating an account or carrying out a trade, you confirm that you have read, understood and agree to these terms, to the Privacy Policy and to the Risk Disclosure.
1. Who we are
1.1. The platform is operated by COINSAFE CAPITAL LTDA, a Brazilian limited liability company registered under CNPJ (Brazilian company taxpayer ID) No. 63.632.720/0001-90, with its registered office at Rua Moritz Germano Hoffmann, 66, 2º andar, Sala 202, Box 380, Centro I, Brusque/SC, CEP 88350-180 ("Coinsafe").
1.2. Official channels: support by email at suporte (arroba) coinsafe.com.br, Monday to Friday, 9 a.m. to 6 p.m. (Brasília time); and the ombudsman by email at ouvidoria (arroba) coinsafe.com.br, for complaints not resolved by support, with a protocol number for each request and a reply within 10 business days. The ombudsman's toll-free phone line will be announced on this website as soon as it is available. Any other official channels will be announced on this website and in the platform dashboard.
2. Terms used in these Terms
2.1. For ease of reading, the following terms have the meanings below:
- Client: an individual or legal entity with an approved account on the platform.
- Platform: the Coinsafe trading dashboard, accessed at app.coinsafe.com.br and api.coinsafe.com.br, and the official support channels.
- USDT: a stablecoin-type virtual asset issued by Tether and pegged to the US dollar.
- OTC Trade: a purchase or sale of USDT negotiated directly between the Client and Coinsafe, outside an order book.
- Quote: the price Coinsafe proposes for a specific trade, with the total amount and validity period stated before acceptance.
- Client Wallet: a blockchain address owned and controlled by the Client and registered on the platform to receive or send USDT.
3. Regulatory status
3.1. Coinsafe acts as an intermediary in virtual asset transactions under Law No. 14,478/2022 and the regulations of the Central Bank of Brazil (Banco Central do Brasil), in particular BCB Resolutions No. 519, 520 and 521 of 2025.
3.2. Coinsafe was already providing virtual asset services before February 2, 2026 and is therefore subject to the transition rules of BCB Resolution No. 520/2025. These rules allow it to keep operating while the Central Bank of Brazil reviews its application for authorization to operate as a virtual asset service provider in the intermediary category, provided the application is filed by October 30, 2026. Coinsafe is not yet authorized by the Central Bank, and authorization may be denied.
3.3. Coinsafe is not a bank, is not a deposit-taking financial institution, and does not provide asset management or investment advice. The amounts and assets involved in trades are not covered by the Fundo Garantidor de Créditos (FGC, Brazil's deposit guarantee fund).
3.4. Under current regulations, the purchase and sale of stablecoins pegged to a foreign currency are subject to rules that apply to the foreign exchange market. For this reason, Coinsafe asks the Client for the purpose of each trade, assesses the Client's profile and familiarity with virtual assets, may request a risk acknowledgment form, applies the per-trade limits set out in the regulations, and reports trade data to the Central Bank and other authorities where the rules require it.
4. What Coinsafe offers
4.1. Coinsafe offers the purchase and sale of USDT against Brazilian reais (BRL) in an OTC format, for individuals and legal entities.
4.2. When buying, the Client pays in reais and receives USDT in the Client Wallet. When selling, the Client sends USDT to the address indicated by Coinsafe and receives reais in a bank account held in the Client's own name.
4.3. Coinsafe does not provide custody services. Coinsafe does not keep a USDT balance on the Client's behalf and does not hold assets for the Client. During settlement, USDT may pass through an address controlled by Coinsafe only for the time needed to complete the contracted trade.
4.4. The blockchain networks accepted for sending and receiving USDT are listed on the platform. Coinsafe may add, suspend or stop accepting networks, with notice to the Client and without affecting trades already confirmed.
5. Who can be a client
5.1. The following may open an account: (a) individuals aged 18 or over with full legal capacity and a CPF (Brazilian individual taxpayer ID) in good standing; and (b) duly incorporated legal entities with an active CNPJ, represented by persons with the authority to do so.
5.2. The Client must provide true, complete and up-to-date information and submit the documents requested during sign-up. For companies, this includes information on partners, officers, representatives and ultimate beneficial owners.
5.3. Every account is reviewed before its first trade. Coinsafe may request additional documents at any time, including on the source of funds and the purpose of trades, and may reject or close accounts that do not meet its compliance policies, without stating the reason where the law or regulations prohibit it.
5.4. The Client must notify Coinsafe of any change to its registration details within 10 business days.
5.5. The account is personal and non-transferable. The Client is responsible for safeguarding its login, password and second authentication factor, and for everything done with those credentials, except where the misuse results from a security failure by Coinsafe.
6. How a trade works
6.1. Request. The Client states, through the platform or an official channel, whether it wants to buy or sell USDT, the amount, the network and the Client Wallet.
6.2. Quote. Coinsafe provides the Quote with the unit price, the total trade amount, the costs included and the validity period.
6.3. Acceptance. The trade is confirmed when the Client accepts the Quote within its validity period, by the means indicated on the platform. Acceptance is binding on both parties.
6.4. Price held. After acceptance, the Quote price does not change due to market movements, provided the Client pays within the stated deadline and for the stated amount. Coinsafe bears any market movement during that window. Settlement delays caused by Coinsafe, by banks or by compliance checks do not change the accepted price.
6.5. Payment. Payment in reais must be made within the stated deadline, from a bank account held in the Client's own name, for the exact amount of the Quote. Coinsafe does not accept third-party payments.
6.6. Payment not as agreed. If payment arrives after the deadline, in a different amount or from a third-party account, Coinsafe may, at its discretion: (a) offer a new Quote; or (b) return the amount received to the originating account within 2 business days, less only documented bank charges, if any.
6.7. Delivery. Once payment is confirmed, Coinsafe sends the USDT to the Client Wallet. When selling, once receipt of the USDT is confirmed on the network, Coinsafe transfers the reais to the Client's registered bank account.
6.8. Settlement may depend on banking hours, blockchain network confirmations and security and compliance checks. Quotes and settlements are made on business days, 9 a.m. to 6 p.m. (Brasília time), unless otherwise stated on the platform, and estimated timeframes are shown on the platform.
6.9. Coinsafe may cancel a trade before settlement only in the event of a manifest and easily noticeable pricing error, well-founded suspicion of fraud, or a legal requirement or order from an authority. The Client is notified immediately, with the reason where the law allows, and receives back the amount or the USDT sent within 1 business day, at no cost.
7. Prices and costs
7.1. Coinsafe's compensation is included in the Quote price (spread). Blockchain network fees and any operational charges are disclosed before acceptance.
7.2. No cost is charged without first being disclosed to the Client.
8. Wallets and sending USDT
8.1. The Client may receive USDT only in wallets it owns that have been registered on the platform in advance. Coinsafe may require proof of control of the wallet.
8.2. The Client is solely responsible for providing the correct address and network. Blockchain transactions are irreversible. Sending to a wrong address or an incompatible network may result in permanent loss, and Coinsafe has no way to recover those assets.
8.3. When selling, the Client must send USDT only to the address and network indicated by Coinsafe for that trade.
8.4. Coinsafe may refuse transfers to or from addresses associated with illicit activity, sanctions or high risk.
9. Anti-money laundering
9.1. Coinsafe maintains a policy to prevent money laundering, terrorist financing and the proliferation of weapons of mass destruction, in accordance with Law No. 9,613/1998 and applicable regulations.
9.2. To that end, Coinsafe identifies and screens Clients, assesses risk, monitors trades and may report trades to the competent authorities, such as the Conselho de Controle de Atividades Financeiras (COAF, Brazil's Financial Intelligence Unit), without notifying the Client where the law so requires.
9.3. Coinsafe may suspend, hold or refuse trades where there are signs of irregularity, a court order or a request from a competent authority.
10. What is not allowed
10.1. The platform may not be used to: (a) carry out any illegal activity; (b) trade on behalf of third parties without authorization and without informing Coinsafe; (c) use funds of illicit origin; (d) commit fraud, simulate trades or conceal the true beneficiary; (e) evade national or international sanctions; (f) attempt unauthorized access to systems or disrupt the operation of the platform.
10.2. Non-compliance may lead to immediate blocking of the account, retention of funds within the limits of the law, and reporting to the authorities.
11. Account security
11.1. The Client must use two-factor authentication, keep its devices secure and notify Coinsafe immediately if it suspects unauthorized access.
11.2. Coinsafe never asks for your password, authentication code or wallet recovery phrase, and never asks for payment to an account that is not in Coinsafe's name. Be wary of anyone who asks for these.
11.3. Coinsafe records logins, quotes, acceptances and communications for security, audit, fraud prevention and compliance with legal obligations.
12. Taxes
12.1. Each party is responsible for the taxes the law assigns to it. The Client is responsible for calculating and declaring any gains and transactions involving virtual assets.
12.2. Coinsafe provides the Receita Federal do Brasil (Brazil's Federal Revenue Service) with the trade information required by law, including through the Declaração de Criptoativos (DeCripto), Brazil's crypto-asset reporting to the Federal Revenue.
13. Liability
13.1. Coinsafe is responsible for the correct execution of confirmed trades, as set out in these Terms.
13.2. Coinsafe is not liable for: (a) errors by the Client in the address or network provided; (b) failures, congestion, forks or rule changes in blockchain networks; (c) acts of the USDT issuer, including freezing of addresses or loss of the dollar peg; (d) unavailability of banks, networks or providers chosen by the Client or outside Coinsafe's control; (e) acts of God or force majeure external to Coinsafe's activity.
13.3. For Clients that are legal entities, Coinsafe's liability is limited to the amount of the trade that gave rise to the damage and does not include lost profits or indirect damages, except in cases of willful misconduct or gross negligence.
13.4. For Clients who are individuals and qualify as consumers, the rules of the Consumer Protection Code (Código de Defesa do Consumidor) apply, and no clause in these Terms limits rights guaranteed by that law.
14. Account suspension and closure
14.1. The Client may request closure of its account at any time through the official channel, provided there is no trade in progress.
14.2. Coinsafe may suspend or close the account with 30 days' prior notice, or immediately in the event of a breach of these Terms, suspected fraud, an order from an authority, or legal or regulatory risk.
14.3. On closure, trades already confirmed will be settled normally, unless legally prevented. Data will be retained for the periods required by law, as described in the Privacy Policy.
15. Communications
15.1. Official communications will be sent to the registered email address, through notices on the platform or through the official channels announced on this website.
15.2. Electronic acceptance of these Terms, of Quotes and of amendments has the same validity as a signed document.
15.3. Coinsafe confirms each acceptance immediately on the platform and by email, with a summary of the trade. These Terms and accepted Quotes are available for viewing and download in the dashboard.
15.4. A Client who is a consumer may withdraw from opening the account within 7 days of signing up, at no cost. Accepted Quotes are executed immediately at the Client's request, at the agreed price.
16. Changes to these Terms
16.1. Coinsafe may amend these Terms by notifying Clients at least 15 days in advance. Changes required by law or by a regulator may take effect sooner.
16.2. If the Client does not agree with the new version, it may close its account at no cost. Changes that increase costs, reduce rights or create obligations for the Client require express acceptance on the platform before the next trade.
17. General provisions
17.1. If any clause is held invalid, the remaining clauses remain in effect.
17.2. Tolerating a breach does not constitute a waiver of rights.
17.3. These Terms were written in Portuguese. Versions in other languages are for reference only, and in case of any difference the Portuguese text prevails.
18. Governing law and jurisdiction
18.1. These Terms are governed by the laws of the Federative Republic of Brazil.
18.2. For Clients that are legal entities, the courts of the Judicial District of Brusque/SC are chosen as the venue. For Clients who are consumers, the venue is the consumer's place of residence, in accordance with the Consumer Protection Code.
